What do I do after an accident?

A concrete action guide and the insurance companies’ contacts.

  1. 1

    Make sure you are OK and check whether anyone needs medical help.

  2. 2

    Don’t move the car.

  3. 3

    While everyone is still shaken, you take photos of the accident.

    For good photos, switch the camera to full mode (or panorama) and shoot from as many angles as possible:

    • all the cars involved in the accident should be in the frame;
    • some photos should show both license plates;
    • take close-ups where the effects of the impact are clearly visible;
    • take photos that record whether there was a braking distance;
    • you can also film a video walking all around, to record every detail.

Settle it amicably or call the police?

Amicable settlement

If it is obvious and admitted who is at fault, and you are absolutely sure the damage to the innocent party is under 15,000 lei, you can settle it amicably.

First, write a signed note in which the person at fault admits it (the note records the time, the place and the cars involved), after which you can clear the road. Both drivers go to the at-fault driver’s insurance company, fill in the form and the claim, and the compensation procedure starts.

With the police

If it is unclear who is at fault, or there is a risk the damage exceeds 15,000 lei, call 112 and wait for the police to document the case.

What the law requires for an amicable settlement

  • Only two vehicles are involved, with no injuries and no other property damaged. Art. 21(3)(a), (c)
  • Both drivers agree, and the one at fault admits it. Art. 21(3)(d)
  • Fill in and sign together the form “Constatare amiabilă de accident” (the joint accident report), or use the service in the government app. You get the form free with your RCA policy or on request. Art. 21(2), (2¹), (5)
  • The paper form must reach the insurer within 2 working days. Art. 18(1)(c), 19(2)
  • Take photos or video of both cars, the license plates, the damaged parts and any braking marks. Also write down the witnesses’ details. Art. 18(1)(c)

The 15,000 lei limit is set by the National Commission for Financial Markets. Above it, in an amicable settlement, the insurer pays only up to the limit. If any condition above is not met, the form becomes void and the accident must be documented by the competent authorities. Art. 13(1)(c), 21(3), (7)
